  1. Section 123 of Armed Forces Act (Nigeria) has its focus on military personnel within the military justice system only:
    The provision is designed to handle offences committed by military personnel and maintain order *WITHIN* the Armed Forces, ***not to govern general civilian offences occurring outside the military’s purview***. The language therein is clear : “…a person subject to service law…that he has committed an offence UNDER THE PROVISION OF THIS ACT…” not under the provision of the criminal code or any law/code outside military purview.

    To put in context the Act (Section 123 stipulates the procedure where, for instance a serving military officer under a Commanding Officer in Asaba travels or offends or commits an offence in Lagos or Kaduna, that offence must be reported to and tried by his Commanding Officer in Asaba and not by anyone else.
